By a 5-4 vote, the court is set to allow the Trump administration to block immigrants from six countries — Syria, Iran, Yemen, Somalia, Libya and Sudan — for 90 days while the administration reviews visa and asylum cases.
The court’s order keeps lower courts from ruling on whether the ban is an illegal attempt to discriminate against Muslims.
Justice Sonia Sotomayor noted that the justices were voting on an emergency motion to stay a lower court order that would have halted the ban. She said she was concerned that the lower court order “may cause irreparable harm to individuals in those countries.”
In the end, the court voted 7-2 to accept the administration’s request for a stay.
The Trump administration says the ban is necessary to prevent terrorists from entering the country. In the ruling, the justices cited evidence that the travel ban helped thwart a series of attacks in the U.S. after the Sept. 11, 2001, attacks.
The justices rejected the Obama administration’s arguments that the ban was overly broad and, as a result, could be used to target U.S. residents for discriminatory reasons.
The court is set to hear oral arguments on April 25, in what promises to be a blockbuster case that could reshape the court and the nation’s immigration policies.
